Problematika Tanah Wakaf Tidak Bersertifikat : Studi Kasus Masjid Istiqomah Kampung Ngembong Pijiharjo Manyaran Wonogiri

Abstract

Waqf actions in Indonesia are closely related to waqf certificates. According to KBBI, a certificate is a sign or a
written or printed statement from an authorized person that can be used as proof of ownership or an event. The
purpose of this research is to answer questions related to what are the factors causing the uncertified waqf land of
the mosque, and the settlement of disputes over waqf land of the mosque, especially in Ngembong Village, Pijiharjo,
Manyaran, Wonogiri. The research method used is a case study with a qualitative approach. Data were collected
through in-depth interviews, observations, and documentation studies. The results showed that the unclear legal
status of waqf land due to the fact that it has not been certified is the main factor triggering disputes. In addition,
the lack of public understanding of the procedures and importance of waqf land certification also exacerbated the
problem. The settlement of mosque waqf land disputes is carried out amicably through village deliberations. This
study recommends the need for socialization and education on waqf land certification to the community, as well
as assistance in the certification process to avoid future disputes.
