PENEGAKAN HUKUM PIDANA OLEH DINAS PERHUBUNGAN (LLAJ) SEBAGAI PENYIDIK PEGAWAI NEGERI SIPIL (PPNS) TERHADAP TINDAK PIDANA PELANGGARAN LALU LINTAS DAN ANGKUTAN JALAN DI KABUPATEN KARANGANYAR
Abstrak
Strict and consistent law enforcement against traffic violations can have a deterrent effect against future violations. A clear threat of punishment can reduce individual motivation to violate traffic rules. Apart from legal sanctions, the Transportation Service can also play a role in educating the public about the importance of obeying traffic rules.
This research method uses a type of empirical legal research, legal research that obtains data from primary data or data or data obtained directly from the community. The research approach carried out by researchers is the normative legal legislation approach and the qualitative approach in empirical legal research.
This research method uses a type of normative legal research, namely a process for finding legal rules, legal principles and legal doctrines to answer the legal issues faced. And empirical law, legal research that obtains its data from primary data or data or data obtained directly from the community, the research approaches carried out by researchers are the normative legal legislation approach and the qualitative approach in empirical legal research.
The research results show that law enforcement by the Transportation Service is based on a strong legal basis, especially Law Number 22 of 2009 concerning Road Traffic and Transportation (UU LLAJ) as well as other related laws and regulations. The importance of cooperation between the Transportation Service and other agencies, such as the Police and Prosecutor's Office, ensures effective coordination in law enforcement. This cooperation is necessary to strengthen enforcement, exchange information and apply appropriate sanctions. The investigation process by the PPNS Transportation Service must be carried out professionally, transparently, and follow applicable legal procedures. The obstacles faced by the Transportation Service (LLAJ) as Civil Servant Investigators (PPNS) in enforcing the law against criminal acts of traffic and road transportation violations can be summarized as follows: limited resources, lack of cooperation and coordination between the Transportation Service, Police, and the Prosecutor's Office, there is an increase in technology.
