PERAN PEMBIMBING KEMASYARAKATAN DALAM PENDAMPINGAN ANAK YANG MELAKUKAN TINDAK PIDANA PERSETUBUHAN
(Studi Kasus Di Pengadilan Negeri Karanganyar)
Abstrak
The purpose of this research is to analyse the role of community advisers
in the mentoring of children who commit criminal acts in the District Court of
Karanganyar. Analyzing the barriers experienced by community advisers in
mentoring children who commit criminal acts in the District Court of
Karanganyar.
The method of approach in writing is sociological juridical. The
specification of this research uses analytical descriptive. Data sources use primary
data and skunder data. Data collection techniques using interview studies, Focus
Group Discussion and observation. To analyze the data, researchers use
qualitative descriptive analysis methods.
The role of public tutoring in the mentoring of children who commit a
criminal offence at the Karanganyar District Court is as follows: The
pre-adjudication stage, which is the stage at the commencement of the police
investigation process against a child who commits a criminal offence. In this stage
the role of the Surakarta Correctional Hall through Community guidance (PK) is
to create a public research report (LITMAS) at the request of the police. The level
of adjudication, which is the stage when the case involving the child facing the
law, has entered into the proceeding. At this stage the role of the Correctional hall
through community guidance is to accompany the child who commits a criminal
offence who becomes his client in any proceedings. Post stage of adjudication,
which is the stage at the time after the case involving the child who commits a
criminal offence is disconnected by the judge. At this stage the role of the
Surakarta Correctional Hall through community guidance was to guide, assist, and
supervise the child's client in the sentence that he had imposed. Community
guidance barriers in mentoring children who conduct criminal acts in the District
Court of Karanganyar, namely: the work area of each Bapas is too broad, so the
distance between the client's residence with many Bapas office is very far, the
number of public advisers is not balanced with the amount of work to be done for
the benefit of the task PK. The financial budget in Bapas to implement the
implementation of mentoring, assistance and supervision of children's clients is
still limited , facilities and infrastructures in Bapas are still relatively limited, such
as operational vehicles for community advisers and public guidance rooms, the
slow demand of litmas from the police, and the lack of coordination from the
police, prosecutors, and the courts to the Bapas in the event of follow-up efforts
on the implementation of the Diversi.
