PELAKSANAAN PENDAFTARAN TANAH SISTEMATIS LENGKAP (PTSL) GUNA LEGALITAS TANAH DI KECAMATAN KARANGJATI KABUPATEN NGAWI

Abstract

This study aims to identify and analyze the implementation of complete
systematic land registration (PTSL) in order to assist the legality of community
land in Karangjati District, Ngawi Regency, analyze the obstacles to the
implementation of PTSL and find efforts to help communities obtain the legality
of their land rights. This study uses an empirical juridical approach. The nature of
this research is descriptive. The technique of determining the informants used
purposive sampling technique. Research informants consist of authorized officials
and community representatives. Data analysis used the Miles and Huberman
model.
The results of the study found that (1) The implementation of complete
systematic land registration (PTSL) to assist the legality of community land in
Karangjati District, Ngawi Regency was quite good in accordance with applicable
government regulations even though there were obstacles or obstacles, but they
could still be overcome. Judging from the legal structure, the authorized officers
in PTSL include Pokmas, village government and employees of the Ngawi
Regency Land Office. In terms of legal substance, the legal basis used in the
implementation of PTSL is (a) Presidential Instruction Number 2 of 2018
concerning Acceleration of Complete Systematic Land Registration in All
Territories of the Republic of Indonesia. (b) Regulation of the Minister of
Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the
Republic of Indonesia Number 6 of 2018 concerning Complete Systematic Land
Registration. Judging from the elements of legal culture, it can be seen from the
public's understanding of the implementation of PTSL that tends to be low. (2)
Obstacles to the implementation of PTSL include (a) Lack of understanding of
some people about the importance of certificates as proof of property rights; (b)
The community's perception that obtaining land certificates requires high costs;
(c) Land proposed for PTSL program is still in dispute with the heirs; (d)
Incomplete files are returned by the Ngawi Regency Land Office to the village for
completion. (3) Efforts that can be made in helping the community to obtain the
legality of their land rights are socializing the importance of certificates, checking
uncertified land and recording detailed data on the land rights area, checking files
thoroughly so that the PTSL process runs smoothly.
