PELAKSANAAN PENDAMPINGAN ANAK YANG MELAKUKAN TINDAK PIDANA PERSETUBUHAN OLEH PEMBIMBING KEMASYARAKATAN (Studi Kasus Di Balai Pemasyarakatan Kelas II Klaten)
Abstract
The purpose of this study is to study and analyze the implementation of
mentoring of children who commit criminal acts of copulation by the Community
Supervisor at the Class II Correctional Center in Klaten. Assessing and analyzing
the obstacles experienced by the Community Supervisor in assisting children who
commit criminal acts of copulation at the Class II Correctional Center in Klaten.
Community Advisors have a function in carrying out community research
which is used as a consideration by investigators in the diversion process at the
police level, as well as during the diversion process at the court level. In addition,
community research reports are also used as one of the judges' considerations in
deciding children's cases that conflict with the law.
The method of approach in writing is sociological juridical. The specifics of
this study used descriptive analytics. The data source uses primary data and skunder
data. Data collection techniques use interview studies and documentation. To
analyze the data, researchers use qualitative descriptive analysis methods.
The implementation of assistance for children who commit criminal acts of
copulation by the Community Supervisor at the Klaten Class II Correctional Center
is very influential on the handling and efforts to resolve cases of Children Facing
the Law, because the Community Supervisor is always present as a Companion for
Children when going through all the stages that children go through in the Judicial
Process. The role of community advisors is: First, as a researcher or information
seeker. Second, as a Mediator. Third, supervise children facing the law while
serving sentences, both criminal penalties and punishments. Obstacles in the
implementation of assistance for children who commit criminal acts of copulation
by the Community Supervisor at the Klaten Class II Correctional Center are: First,
limited opportunities to express opinions in the trial. Second, The lack of
coordination between fellow law enforcement officers is due to disagreements in
understanding the law on the Juvenile Criminal Justice System. Third, Limited
human resources in quality from community advisors. Fourth, The limited number
of Community Advisors, so that they often find it difficult to assist children facing
the law, which is not small in number, coupled with the large area of duty of the
Correctional Center.
