PELAKSANAAN AMAR MA’RUF NAHI MUNKAR SEBAGAI BUDAYA HUKUM DALAM PENEGAKAN HUKUM

(Studi Kasus Pada Organisasi Front Pembela Islam di Surakarta)

Abstract

The purpose of this study is to investigate the implementation of the amar
mar'uf nahi munkar implementation in the Surakarta Islamic Defenders Front
organization and to determine the impact of the implementation of amar ma’ruf
nahi munkar on the culture of law enforcement and social order in Surakarta.
The background of this research is the practice of charity amar ma'ruf nahi
munkar in the community carried out through social institutionalization that is
centered on regular institutions, namely mosques and formal institutions, namely
Islamic da'wa organizations. FPI is one of the Islamic da'wa organizations that is
actively involved in a number of law enforcement actions in the community. In
many ways, what FPI did was seen as not in line with the law enforcement
procedures, because what was done was a main duty of the Indonesian National
Police. In fact what is done by FPI is one of social action which has legal
dimension, because the source of the problem comes from social disorder, weak
law enforcement and religious beliefs.
This research is a type of empirical / sociological juridical legal research
research and when viewed from the nature of the study, including descriptive
research. The location of the study was in the Office of the Regional Council of
Islamic Defenders Front Surakarta. Types of data used include primary and
secondary data, data collection techniques used are interviews, literature studies in
the form of legislation, books, journals and other documents that are relevant and
related to the writing of this law. Data analysis uses qualitative data analysis.
The results of this study indicate that the implementation of amar ma'ruf
nahi munkar is guided by several mechanisms, namely: The case of amar ma'ruf
nahi munkar which will be fought for must first be assessed based on Islamic
sharia by experts, taking formal state legal procedures in force, through gathering
facts as legal evidence, Gathering concrete support from the surrounding
community, Reporting and claiming to all state agencies that are authorized and
the impact of the implementation of the Amar Ma'ruf Nahi Munkar Legal Culture
by the Islamic Defenders Front is recognized by the police as helping the
performance of law enforcement that should be carried out by the Police to bring
order social.
