Abstract

The purpose of this study is to examine and analyze the implementation of diversion against children in the case of the crime of beatings that has been determined by the Sukoharjo District Court and also examine and analyze the obstacles that occur in implementing diversion. Crimes committed by children in general are a process of imitating or being influenced by the persuasion of adults. The formal criminal justice system which ultimately places children in the status of convicts certainly has considerable consequences in terms of the child's development The approach method in this study is empirical juridical research, namely research on the effectiveness of law, which discusses how law operates in society. This research specification uses descriptive. Source of data using primary data and secondary data. Data collection techniques using interviews and literature study. To analyze the data, researchers used a qualitative descriptive method. Based on the results of the study, it was concluded that in the implementation of the determination of diversion Number 1 / Pen.Div / 2021 / PN.Skh jo. Number 3 / Pid.Sus-Children / 2021 / PN Skh which should have been carried out by the Klaten Class II Bapas has been carried out properly and in accordance with the Stipulation by the Surakarta Class 1 Father because the location of the Child is in the area of the Surakarta Class 1 Fathers. The obstacles experienced by community counselors in carrying out this determination so far are activity restrictions by the government due to Covid 19.
