KEDUDUKAN DAN PENGAKUAN HUKUM SURAT KETERANGAN TANAH ADAT (SKT-A) DAMANG KEPALA ADAT DAYAK DI KABUPATEN KOTAWARINGIN TIMUR PROVINSI KALIMANTAN TENGAH
Abstract
The purpose of the research in this thesis is to examine the position and legal recognition of the Customary Land Certificate (SKT-A) Damang Dayak Customary Head, East Kotawaringin Regency, Central Kalimantan Province regarding: (1) What is the position and legal recognition of the Customary Land Certificate (SKT-A). A) made by the Customary Head Damang; (2) What are the stages of obtaining a Certificate of Customary Land (SKT-A); (3) Requirements, Prohibitions, Financing, and Archiving of Customary Land Certificates (SKT-A); (4 What is the type of ownership of Customary Land and Customary Rights on Land.
The authority of the Customary Head Damang to make a Customary Land Certificate (SKT-A) as regulated in Article 10 Paragraph (1) Letter D of the Customary Institution Regulation. If it is reviewed more deeply in the explanation section of Article 10 Paragraph (1) Letter D of this Customary Institution Regulation, then the Customary Land Certificate, if desired by the right holder, this SKT-A can be used as evidence of control of land rights which can be registered in accordance with the provisions of the right. on the applicable land in accordance with the Basic Agrarian Law. Land Certificates are generally issued by the Village Head/Lurah.
The problems in this study, namely: (1). What is the position and legal recognition of the Customary Land Certificate (SKT-A) made by the Customary Head Damang? (2). What are the stages of obtaining a Customary Land Certificate (SKT-A)? (3). What are the requirements, prohibitions, financing, and filing of Customary Land Certificates (SKT-A)? (4). What are the types of customary land ownership and customary rights on land?
The research method used is normative. This type of juridical research is sourced from statutory regulations, books, official documents, and research results as well as legal research methods that function to see the law in a real sense and examine how the law works in the community.
The conclusions in this thesis are: (1). The position and acknowledgment of the Customary Land Certificate (SKTA) issued by Damang is valid and used; (2). Besides that, to get a Certificate of Customary Land (SKTA) issued by Damang, through eight stages; (3). People seeking Customary Land Certificates (SKTA) must bear the costs, pay attention to prohibitions and archives; (4). The land ownership consists of: Jointly Owned Customary Land, Individually Owned Customary Land, and Customary Rights on Land.
