PELAKSANAAN PENYUSUNAN PROGAM PEMBENTUKAN PERATURAN DAERAH INISIATIF

Abstract

The purpose of this research is to identify the implementation and to find out
the obstacles in the process of forming the initiative local regulations. One of the
functions of the DPR is to form Regional Regulations, in the process carried out by
discussing with the regional head and approving or disapproving the draft regional
regulation, proposing a draft regional regulation, and preparing a program for the
formation of regional regulations with the regional head. Therefore, this study will
examine the implementation of the formation of regional regulations by the DPRD
as an element of regional apparatus in the legislative process.
At this writing the researchers based on the type of empirical juridical research.
This research is descriptive qualitative, the approach used is an interactional/micro
approach with qualitative analysis. Researchers used data collection techniques as
follows: literature study, observation, and interviews.
The results of the study found that, in Law Number 12 of 2011 concerning the
Establishment of Legislations as amended by Law Number 15 of 2019 concerning
Amendments to Law Number 12 of 2011 concerning the Establishment of
Legislations, especially Article 1 number 1 it is stated that the formation of laws
and regulations is the making of laws and regulations that include the stages of
planning, drafting, discussing, ratifying or determining, and enacting. Although the
process emphasizes the role of the DPRD, at least there must be provisions on the
role or participation of the community in determining the plan for the formation of
initiative regional regulations. In the practice of making initiative regional
regulations, various problems arise, including: the preparation of the initiative for
the establishment of regional regulations has not been based on a priority scale; the
program for the formation of the initiative regional regulation only contains a list
of the titles of the draft initiative regional regulations without being based on an indepth
study as outlined in the information, explanations or academic texts of the
draft initiative regional regulations.
