UPAYA PENERAPAN DIVERSI DALAM PERKARA LAKALANTAS PADA TINGKAT PENYIDIKAN DIWILAYAH HUKUM POLRES BAUBAU

Abstract

This study aims to find out and analyze the obstacles faced by police
investigators in implementing the div for traffic accidents and to find out and
analyze the application of diversion to traffic accidents.
The research method used is this type of research is empirical legal
research. This research was conducted in Baubau City, namely Baubau City
POLRES. The population in this study was taken from several community
members/families of victims and suspects and several investigators who were
around the Baubau POLRES legal area. The types of data collected in this study
are primary data and secondary data. Data collection techniques used in writing
this thesis are observation, interviews, and documentation. The method in this
study using qualitative methods.
The results of the study indicate that not all cases of traffic accidents
involving children can be resolved through Diversion, because Diversion can be
realized if it has fulfilled the conditions specified in the applicable regulations and
there is an agreement between the perpetrator and the victim for Diversion. The
lack of public understanding about diversion and the lack of clear and detailed
regulation of compensation between perpetrators and victims who make diversion
efforts in Law Number 11 of 2012 concerning the Juvenile Criminal Justice
System are important obstacles / obstacles in the process of implementing the
Diversion.
