KEDUDUKAN HUKUM PERJANJIAN PENGIKATAN JUAL BELI (PPJB) DALAM HAL TERJADI SENGKETA DI KOTA BAUBAU
Abstract
This study aims (1) to determine and analyze the legal position of the
sale and purchase binding agreement in the event of a dispute, (2) to determine
and analyze the legal protection for (land buyers) based on the sale and purchase
agreement in full in the event of a dispute.
The research method in writing this thesis is to use descriptive
qualitative analysis techniques with data collection methods used are library
research and interviews, while the types of data used are secondary data as main
data and primary data as supporting data.
The results of the study show that in the case that the author examines,
it can be concluded that when viewed from the terms of the validity of the
agreement, the first Sale and Purchase Binding Agreement can be said to be valid
and binding on the parties. Because the conditions for the validity of the
agreement are met. The legal protection of the buyer in the PPJB deed actually
has layered legal protection, including the notarial PPJB deed, based on Article
1338 of the Civil Code, as well as the good intentions of the parties to fulfill the
agreement that has been made.
