Abstract

This writing aims to find out: 1) How is criminal law enforcement in
tackling criminal acts resulting from illegal logging based on law number 18 of
2013 concerning forest prevention and destruction (Case Study in Baubau City),
and 2) Factors influencing enforcement criminal law in tackling criminal acts
resulting from illegal logging based on law number 18 of 2013 concerning forest
prevention and destruction (Case Study in Baubau City).
The research method used is the type and source of the data obtained
through legal materials as primary data and supported by secondary data from
books, laws and regulations and others. This study uses qualitative data analysis.
The results of the study show that in dealing with crimes resulting
from illegal logging based on Law Number 18 of 2013 concerning Prevention and
Destruction of Forests (Case Study in Baubau City are: 1) Enforcement of
criminal law in criminal acts resulting from illegal logging, there are no timber
documents that transported in the form of a transportation memorandum and
certificate of ownership of teak wood rights processed by SKSHH which are legal
in the Labalawa protected forest area based on the Decree of the Minister of
Forestry of the Republic of Indonesia Number: SK.465/Menhut-II/2011 dated
August 9, 2011, so that the perpetrators of criminal acts resulting from illegal
logging uses transport memorandum documents and certificates of ownership of
teak wood rights from processed forest products that are not in accordance with
their designation as regulated in laws and regulations., and 2) Factors that affect
the enforcement of criminal law in criminal acts resulting from illegal logging, the
unavailability of a Technical Implementation Unit structure. UPT Forest
Management Unit, hereinafter abbreviated as UPT KPH, specifically for the
Labalawa protected forest area.
