TINDAK PIDANA PELANGGARAN LALU LINTAS YANG DILAKUKAN OLEH ANAK SETELAH BERLAKUNYA UNDANG-UNDANG NOMOR 11 TAHUN 2012 TENTANG SISTEM PERADILAN ANAK DI POLRES SEMARANG

Abstract

This study aims to determine the application of criminal law to traffic
violations that cause death by children at the Semarang Police Station. The
research conducted by the author uses qualitative research. Data analysis used an
interactive analysis model, with stages of data reduction, data presentation and
then drawing conclusions. The results of the analysis show that the application of
the law by Semarang Police investigators who made a police report against the
suspect was not based on the provisions of the Criminal Code but by providing an
indictment with Article 310 of the Traffic and Road Transport Law Number 22 of
2009 was correct considering that legal science recognizes the principle which
states that more specific regulations take precedence over general regulations (lex
specialist degorat lex generalis), in the sense of the Road Traffic and
Transportation Law no. 22 of 2009 (lex specialist) overrides the Criminal Code
(lex generalis).
