PENYIDIKAN TINDAK PIDANA PENCURIAN DENGAN PEMBERATAN

(Studi Kasus di Wilayah Hukum Polres Klaten)

Abstract

The purpose of this study is to analyze the investigation of the crime of
theft with its weights and obstacles, especially those that have been handled at the
Klaten Police.
The background of the research is that at the Klaten Police there has been
a case of theft with weights carried out by two people in an alliance and carried
out in a destructive way before the perpetrators take other people's belongings.
The case is interesting to analyze, namely when investigators try to uncover the
facts in fulfilling the juridical elements of the crime of theft by weighting.
The research method consists of the type of research is normative
juridical, the nature of the research is descriptive. The data needed is secondary
data, while the data collection method is done by means of literature study. The
data analysis method was carried out qualitatively.
The results showed that the investigation of the criminal act of theft by
weight was carried out without any coercion. The fulfillment of the elements of
the crime of theft with weights is obtained from the statements of several
witnesses and the statements of the suspect. The obstacle is that revealing the facts
takes a long time, important evidence is often lost.
