Abstract

Investigations against children who have committed criminal acts should
be handled by child investigators who meet the requirements as stipulated in the
Law on the Criminal Justice System for Children, but the fact is that there are
child investigators who have not met the requirements, so that they have the
potential to carry out investigations that are not mandated by the Law on the
Criminal Justice System. Child. What is the role of the investigator in
investigating criminal acts committed by children and why is there an inhibiting
factor in the role of the investigator in investigating crimes committed by children
at the Baubau Police?
The research was conducted with a normative juridical approach and an
empirical juridical approach. Resource persons consisted of BauBau Police
Investigators. Data collection was carried out by literature study and field studies.
The data analysis was done qualitatively.
The results of this study indicate: The role of investigators in
investigating criminal acts committed by children at the BauBau Police includes
normative and factual roles. The normative role is carried out by statutory
regulations, particularly the Police Law and the Children Criminal Justice System
Law. The factual role is carried out based on the facts regarding the existence of a
child who has committed a criminal offense by providing a special child
investigator, carrying out investigations in a special examination room for
children, carrying out investigations in a family atmosphere, requesting a social
research report, carrying out forced efforts guided by the Law on the Juvenile
Justice System . Investigations against children are realized by investigators by
means of investigations in a family manner, not wearing official clothes and not
putting pressure on children. The most dominant factor that hinders the role of
investigators in investigating criminal acts committed by children at the BauBau
Police is the community factor, especially the victim and the victim's family
rejecting diversion and wanting the child as the perpetrator of a criminal act to be
prosecuted.
Research suggestion: The role of investigators in investigating crimes
committed by children should be adjusted to the juvenile criminal justice system.
Counseling / socialization regarding diversion to the public should be increased so
that people have a good understanding of diversion and as an effort to minimize
resistance to diversion by the community.
