Abstract

The purpose of this study was to determine the Issuance of a PTSL
Certificate by the Konawe Regency Land Office based on the Ministerial
Regulation of ATR/KBPN Number 6 of 2018 concerning Complete Systematic
Land Registration and to find out the obstacles to the Implementation of the
Issuance of a PTSL Certificate at the Konawe Regency Land Office.
The background of this research is Article 33 paragraph (3) of the 1945
Constitution of the Republic of Indonesia has provided the basis that the earth and
water and the natural resources contained therein are controlled by the State and
used for the greatest prosperity of the people. legal certainty to land rights holders,
in Government Regulation No. 24 of 1997 concerning Land Registration, it has
been emphasized that certificates are strong evidence.
This research method is a normative-empirical legal approach. The
normative-empirical legal research method regarding the implementation of
normative legal provisions (laws) in action on certain legal events in a society.
This type of normative research is a type of research that emphasizes the study of
legal science and tries to emphasize the legal rules that apply in relation to the
position of land.
The results of this study are the Complete Systematic Land Registration
Issuance Process carried out by the Konawe Regency Land Office that is not in
accordance with the procedures including the submission of certificates that
exceed the provisions and the presence of PTSL participants who have not
received the certificate as well as the obstacles experienced by the holding
certificate officer including the lack of surveyors. , the broad terrain of the
certificate location, the terrain of the certificate which is a mountain slope, and the
distance from the Konawe Regency Land Office which is far away.
