PEMBENTUKAN PERATURAN HUKUM DAERAH YANG DEMOKRATIS OLEH PEMERINTAH DAERAH KOTA BAUBAU

Abstract

The urgency of applying the principle of democratic openness in the
formation of regional legal regulations by the local government of Baubau City
and the implementation of the principle of Openness in the formation of regional
regulations of Baubau City, regional legal products in the form of regional
government decisions and regional regulations can be trapped as legal products
that are legally flawed, even though each formation Regional legal regulations
must always pay attention to the concept of the rule of law, the principles of
openness and democracy in the formation of statutory regulations, and general
principles of good legislation. So the writing of this thesis examines the
application of statutory principles and the implementation of the formation of
regional legal regulations by local governments.
The approach to be used is an empirical juridical approach. Research
based on a positive law inventory, the discovery of legal principles and legal
findings, which is complemented by observations of the operationalization of
legal principles empirically in society.
The existence of regional legal regulations in their formation by the
regional government is in accordance with the principles of good legislation, in
accordance with Law of the Republic of Indonesia Number 10 of 2004 concerning
the Formation of Legislation.
The principle of democracy has been applied in the formation of regional
legal regulations by the Regional Head which is contained in: the proposed draft
regional regulations come from the Regional Government and DPRD; the process
of making laws and regulations in a planned, integrated and systematic manner.
