PERLINDUNGAN HUKUM BAGI ANAK PELAKU TINDAK PIDANA DALAM PROSES PERADILAN PIDANA PADA POLRES BAUBAU

Abstract

Children are the future of our civilization, our treatment of our children
now is the same as we are structuring and determining the direction of our
civilization, therefore it is necessary to be careful and care about the future of our
civilization with the equivalent that our concern for children is our concern for the
future of our civilization.
This study aims to determine the legal protection and rights of minors
who commit criminal acts in Baubau City. This research includes the typology of
juridical normative and sociological juridical research. The research was collected
by means of document / literature study and interviews with investigators at the
BauBau Police. The analysis was carried out using a statutory approach.
The results of the study show that in general the protection of children
who commit criminal acts is in accordance with Article 3 of Law Number 11 of
2012 concerning the Child Criminal Justice System. Rights and legal protection
for children who commit criminal acts in addition to being in accordance with
Law Number 11 of 2012, also meet the criteria for the principle of legal protection
principles, namely 1) Children cannot fight alone; 2) The best interests of the
child; 3) The recycle of life; and 4) Cross-cutting.
The criteria for investigators to fulfill children's rights and legal
protection are in accordance with Law Number 11 of 2012 concerning the
Criminal Justice System for Children.
