PENEGAKAN HUKUM TERHADAP PELAKU TINDAK PIDANA PERDAGANGAN ILEGAL SATWA LIAR YANG DILINDUNGI BERDASARKAN UNDANG-UNDANG NOMOR 5 TAHUN 1990 TENTANG KONSERVASI SUMBER DAYA ALAM HAYATI DAN EKOSISTEMNYA

(Studi Kasus di Wilayah Hukum Jawa Tengah)

Abstract

The purpose of this research is to assess and analyze law enforcement against
perpetrators of illegal trade of wildlife protected under Law No. 5 of 1990 on the
conservation of natural resources and ecosystems in Central Java law. To assess
and analyse law enforcement barriers in implementing law enforcement against
perpetrators of illegal wildlife trade crimes protected under Law No. 5 of 1990 on
the conservation of natural resources and ecosystems in Central Java law.
The method of approach in writing is sociological juridical. The specification
of this research uses analytical descriptive. Data sources use primary data and
skunder data. Data collection techniques using interview studies, Focus Group
Discussion and observation. To analyze the data, researchers use qualitative
descriptive analysis methods.
Based on the results of the research concluded that law enforcement against
perpetrators of criminal acts of hunting and trade of protected wildlife in the region
of Central Java Natural Resources Conservation Center is still very weak this
happens because: in the absence of compassion and humanitarian considerations,
there are certain persons who play to relieve punishment, very wide area of natural
Resources Conservation Hall of Central Java with very limited personnel or even
less and limited operational funds. The constraints faced in law enforcement
against perpetrators of criminal acts of hunting and illegal wildlife trade in the
region of Central Java Natural Resources Conservation Hall are: lack of
coordination with related apparatus in connection with the handling of protected
animal hunting so that the case does not arrive at the investigation due to the
constraints of no suspect, the suspect fled (DPO), the evidence can not be identified
because it is Efforts to overcome the constraints are: the handling of conflicts
between human beings with good and complete animals, the involvement of the
parties to overcome the hunting of animals that are protected both forestry, local
government and community officials, counseling and socialization, improving and
empowering the economic Community around the region, thorough investigation
of the hunting of protected animals.
