State/regional claims are collected first by Central/Regional Government agencies, however, if the State/Regional Debtor still does not pay off the debt, then the collecting of the Claims is handed over to State Claims Affairs Committee (PUPN). PUPN collects State/Regional Claims optimally, if there are still remaining debts that have not been resolved by the Debtor, PUPN can determine State Claims Temporarily Uncollectible (PSBDT). State Claims that have been designated as PSBDT can be written off.</em></p> <p><em>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The procedures, work procedures, and forms of letters used in writing off state/regional Claims which have been processed by the PUPN, have been regulated in detail. Kasus kekerasan yang melibatkan anak, baik sebagai pelaku maupun korban, meningkat tajam di Indonesia dari tahun ke tahun dan telah mencapai tingkat yang mengkhawatirkan. Kenakalan remaja adalah perilaku kenakalan anak-anak yang merupakan gejala sakit (patologi) secara sosial yang disebabkan oleh suatu bentuk pengabaian sosial sehingga mengembangkan perilaku yang menyimpang. Berdasarkan data Dinas Pemberdayaan Perempuan dan Perlindungan Anak Kota Baubau, pada Tahun 2023 Kota Baubau tercatat terjadi 32 kasus kekerasan terhadap kelompok Anak. Hal ini menunjukkan masih cukup tinggi korban kekerasan anak.</em></p> <p><em>Metode peneliti akan menggunakan metode deskriftif analisis yaitu dengan menganalisa data yang telah dikumpulkan dari berbagai sumber kemudian membagi kedalam fakta dan opini untuk mendapatkan jawaban terhadap permasalahan dan yang kemudian ditarik kesimpulan.</em></p> <p><em>Hasil Penelitian menyimpulkan bahwa (1) Pelaksanaan penegakan hukum yang dilakukan oleh Polres Kota Baubau terkait penyelidikan dan penyidikan maupun melakukan sosialisasi kepada masyarakat terkait tindak pidana kekerasan yang dilakukan anak di Wilayah Hukum Polres Baubau pada dasarnya telah mengikuti peraturan yang ada sesuai dengan peraturan Undang-undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak (SPPA), dan Undang-undang Nomor 35 Tahun 2014 Tentang Perlindungan Anak; (2) Kendala dan hambatan dalam penegakan hukum pada kasus tindak pidana kekerasan yang dilakukan anak yang ditangani oleh Unit Pelayanan Perempuan dan Anak (Unit PPA) Sat Reskrim Polres Kota Baubau yaitu: (1) Terlambat melaporkan, (2) Korban tidak visum, (3) seorang saksi tidak mau ikut memberikan kesaksiannya, (4) Keterangan yang tidak jelas atau berbelit-belit. </em><em>Dalam hal anak sebagai pelaku kekerasan, seseorang yang menyaksikan kejadian agar berani melaporkan jika terjadi kasus kekerasan menimpa seseorang agar kejadian tersebut dapat diproses agar barang bukti secepatnya didapatkan oleh penegakan hukum. This figure is fairly high throughout 2023. However, what is quite concerning about the high divorce rate in the Republic of Indonesia is that the rights of women and children after divorce are often neglected. In fact, women and children are vulnerable groups and really need legal protection from the state, because women and children are the parties who are most often victimized and feel the negative impact of a divorce. </em></p> <p><em>This research uses an empirical juridical legal approach method, which uses secondary data and primary data derived from books, or legal literature, laws and regulations, interviews and other materials. The theory used to analyze and discuss the problems in this study uses the theory of legal protection put forward by Philipus M. Hadjon. </em></p> <p><em>The results of this study conclude that there are forms of legal protection for the rights of women and children after divorce as stipulated in Article 41 letter (c) of the Marriage Law, Article 149 of the Compilation of Islamic Law, SEMA No. 3 of 2018 and SEMA No. 2 of 2019, which in essence the panel of judges can order the former husband to pay to the former wife in the form of mut'ah maintenance, iddah maintenance, madhiyah and child maintenance. However, there are obstacles to legal protection of the rights of women and children after divorce through judicial institutions, especially in the Sukoharjo Religious Court, namely the complicated execution process and expensive execution costs as well as low legal awareness. This writing will be carried out by observations at the Madiun Regency Agriculture and Fisheries Service, to obtain maximum data. Data collection from primary data and secondary data and data analysis using data collection techniques based on applicable laws and regulations.</p> <p>The results of this research show that supervision and because of the weak control system of superiors in supervising subordinates as well as the lack of understanding and attitudes of civil servants towards regulations related to work discipline are still underestimated. This factor is what causes there to be so many violations that every day, if seen from the results of observations, it can be seen that on average there are two to three perpetrators who commit minor violations. Enforcement of discipline can encourage civil servants to be more productive based on the career system and work performance system and moral integrity is a consideration in career development. This is a general explanation contained in PP 94/2021 which explains the importance of civil servant discipline rules. Enforcing civil servant discipline is something that must be carried out by every work unit, including the Madiun City Land Office. Penelitian ini bertujuan untuk mengetahui indikator sehingga Notaris dapat dibebani pertanggungjawaban terhadap isi Akta Autentik yang dibuatnya serta menjelaskan bentuk pertanggungjawaban yang dapat dijatuhkan kepada Notaris terhadap isi Akta Autentik yang tidak sesuai dengan fakta. Metode penelitian yang digunakan dalam penelitian ini adalah penelitian normatif dan didukung oleh data wawancara. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach), pendekatan kasus (case approach), dan pendekatan perbandingan (comparative approach). Penelitian ini menggunakan sumber data sekunder yang terdiri dari bahan hukum primer sekunder, dan tersier. Adapun metode analisis pada penelitian ini adalah menggunakan analisis kualitatif. Perlindungan hukum terhadap Notaris oleh Majelis Kehormatan Notaris (MKN) dalam dugaan tindak pidana yang dilakukan oleh Notaris, terhadap jabatan Notaris melalui MKN dapat dilakukan secara represif karena terkait dengan penerapan Pasal 66ayat (1) UUJN , yaitu dalam memberikan persetujuan atau menolak permintaan penyidik yang hendak memanggil Notaris dalam proses peradilan Keberadaan Majelis Kehormatan Notaris ini sebagai lembaga perlindungan hukum terhadap jabatan Notaris. Kendala yang dihadapi dalam implementasi upaya pendekatan keadilan restoratif yaitu kendala dari pihak kelurga korban, terjadinya pemerasan dari pihak keluarga korban terhadap pelaku, petugas balai pemasyarakatan yang terbatas, dan tidak terjadi kesepakatan diversi. Judging from the philosophical and ideals and philosophy of the Indonesian nation as enshrined in Pancasila and the 1945 Republic of Indonesia Constitution, Article 27 paragraph (2) concerning citizens' rights to workers and the right to a decent living for humanity and Article 28 letter D of the State Constitution Republic of Indonesia of 1945 that, every person has the right to work and receive fair and decent compensation and treatment in employment relationships. with government intervention mandated in Law Number 11 of 2020 concerning Job Creation in the Employment cluster covering three laws which were merged into one, namely Law Number 13 of 2003 concerning Employment, Law Number 40 of 2004 concerning Guarantee Systems Social, and Law Number 24 of 2011 concerning Social Security Administering Bodies. including Law Number 43 of 2014 concerning Regional Autonomy, there have also been changes, in the Employment cluster the government is trying to harmonize the laws governing Job Creation strategic policies.</p> <p>The formulation of the problem raised by the author in this research is, How is the implementation of legal protection for labor through BPJS Employment in Tanah Datar Regency, and the obstacles in implementing legal protection for Labor through BPJS Employment in Tanah Datar Regency. This type of research is sociological or empirical legal research which is initially researched with secondary data, and then continued with research on primary data in the field, or on society.</p> <p>The results of this research show that legal protection for workers through BPJS Employment has not been maximized, there are still many business entities that have not registered their workforce in the 5 BPJS Employment programs, Batusangkar Branch. There are 2 obstacles to legal protection for workers, namely internal and external. Internally, these are work relations, work conditions, work agreements, collective work agreements, company and trade union regulations, these things are not yet running in accordance with applicable regulations. The external factor is that law enforcement in imposing administrative sanctions is not working because the formation of regional autonomy laws which are regional authority has moved to the</p> <p>&nbsp;</p> <p>&nbsp;</p> <p>province, there is a lack of facilities and infrastructure and the budget is not available and the public's understanding of the Job Creation Law is very minimal. Law enforcement officers involved in handling ABH must not only refer to Law of the Republic of Indonesia Number 11 of 2012 concerning the Juvenile Criminal Justice System or other statutory regulations relating to handling ABH, but prioritize peace rather than the formal legal process that is starting to take effect. 2 years after the Juvenile Criminal Justice System Law was promulgated or came into force on August 1 2014 (Article 108 of Law No. 11 of 2012 concerning the Juvenile Criminal Justice System). The research method uses a type of empirical normative research, namely using a statutory approach and a case approach with legislation relating to diversion. Data analysis uses normative qualitative methods.</em></p> <p><em>The results of data analysis found that law enforcement against children who commit criminal acts of bullying and abuse is carried out in accordance with the provisions of Law of the Republic of Indonesia Number 11 of 2012 and the SPPA Law. The diversion process is carried out through deliberation involving children and their parents/guardians, victims and their parents/guardians, Community Counselors, Social Workers, Community Figures, the Legal Aid Institute (LBH Sakti Karanganyar) and Psychologists based on a restorative justice approach. Factors that influenced the failure of diversion efforts in this case included legal regulations, law enforcement, facilities and community compliance. Differences in perception and low understanding in the community regarding the goals of diversion are factors inhibiting the achievement of diversion goals. The existing laws and regulations have not been able to accommodate legal issues that occur in society. In accordance with the above context, this research focuses on the following research objectives: (1) To review and analyse the implementation of Supreme Court Regulation Ri Number 4 of 2020 concerning Administration and Trial of Criminal Cases in Courts Electronically during the co-19 pandemic, (2) To review and analyse what are the factors inhibiting the implementation of Supreme Court Regulation Ri Number 4 of 2020 concerning Administration and Trial of Criminal Cases in Courts Electronically during the co-19 pandemic.</p> <p>This research is a normative legal research using a statutory approach and a cumulative approach. The sources of legal materials used are primary, secondary, and tertiary legal materials. The method of collecting legal materials is a literature study (libary research) and searching through online media (online research).
